October 2025 saw the issuance of a number of important legal documents with far-reaching effects on tax administration, public investment, procurement, customs, and enterprise operations. Value-Added Tax (VAT): E-Invoices and Refunds for Exported Goods

The General Department of Taxation issued Official Letter No. 4422/TCT-CS (2 October 2025) providing guidance on the conditions for a VAT refund on exported goods that have been returned, requiring enterprises to prepare an adjustment dossier and file a supplementary declaration in the nearest tax period.

At the same time, Official Letter No. 4286/TCT-CS (7 October 2025) specifically prescribes the timing for issuing an e-invoice where goods are delivered in multiple batches, in order to improve consistency in VAT declaration and accounting.

Corporate Income Tax (CIT): Incentives Applied to High-Tech and Green Manufacturing Enterprises

Under Circular No. 85/2025/TT-BTC (10 October 2025), enterprises investing in renewable energy, data centers, chip manufacturing, new materials, and electronic equipment will enjoy a preferential tax rate of 10% for 15 years, a 4-year tax exemption, and a 50% reduction for the following 9 years.

The tax authority notes that enterprises must separately account for the income eligible for the incentive, and must satisfy the conditions on investment dossiers and demonstrate the legitimacy of their capital sources, in order to avoid a subsequent tax reassessment.

Personal Income Tax (PIT): Preparing for the New PIT Law

The draft (replacement) PIT Law continues to be refined, and is expected to be submitted to the National Assembly at its November 2025 session.

The key contents include:

–  Adding provisions taxing income from securities transactions, virtual currency, and bonus shares;

–  Applying a flexible personal-deduction mechanism based on average income and the consumer price index;

–  Expanding the scope of tax exemptions/reductions for income from education, digital transformation, and innovative start-ups.

Other Taxes: Detailed Guidance on the Law Amending 8 Laws on Finance, Investment, and Land

The Government has issued a series of decrees — Decree No. 246, No. 248, and No. 252/2025/ND-CP (effective from 15 October 2025) — guiding the implementation of the 2024 Land Law, the 2024 Law on Real Estate Business, and the 2024 Law on Bidding, notably including:

–  Enterprises may credit input VAT on land rental where the non-cash payment condition is satisfied;

–  Import duty exemption for equipment and components used for research and technology transfer;

–  The threshold for direct contractor appointment is adjusted upward to VND 1 billion for consulting services and VND 2.5 billion for goods and construction/installation.

Other Matters: Labor, Insurance, and Personal Data Protection

–  Decision No. 2110/QD-TTg (10 October 2025) adjusts the 2026 management expenditure levels for social insurance (SI), health insurance (HI), and unemployment insurance (UI), including increased spending on personnel training and the application of digital technology.

–  Decree No. 271/2025/ND-CP (20 October 2025) provides guidance on penalties for violations in the field of personal data protection, requiring enterprises to complete their data protection impact assessment reports before 31 December 2025.

–  Official Letter No. 4601/BTC-TCNH (22 October 2025) provides guidance on the management of outward investment capital accounts, ensuring control over cash flows and tax obligations upon the repatriation of profits to Vietnam.
