ACAC – Updates on Tax Policies, Investment, and Financial Management | September 2025

September 2025 saw the issuance of numerous important legal documents, profoundly affecting tax management, public investment, bidding, customs, and enterprises. 1. Value Added Tax (VAT): Refund Guidance and 0% Rate Application

The Ministry of Finance issued Decision 3078/QĐ-BTC (03/09/2025) regulating VAT refund procedures for commercial banks acting as refund agents for departing customers. The new process allows electronic submission via the National Public Service Portal, reducing processing time to 3 working days from the date of receipt.

Additionally, Decree 181/2025/NĐ-CP provides detailed guidance on the 2024 VAT Law, expanding the 0% tax rate to goods sold into non-tariff zones, on-site export goods, and services provided directly to organizations within non-tariff zones — marking an important step toward policy transparency and export promotion.

2. Corporate Income Tax (CIT): Incentive List and Conditions from 01/10/2025

Under the 2025 CIT Law (effective from 01/10/2025), 18 new priority sectors and industries have been identified, including:

  • Application and development of high technology, chip manufacturing, data centers, renewable energy;
  • Production of supporting industrial products, information security, key digital technologies;
  • Investment projects with scale over VND 12,000 billion;
  • Socialization in education, healthcare, sports, culture, and environment.

Enterprises seeking incentives must separately account for income from incentivized activities, ensuring proper documentation, accounting records, and investment conditions. Non-compliance may result in tax arrears recovery and administrative penalties.

3. Personal Income Tax (PIT): Preparing for the Replacement PIT Law

On 05/08/2025, the Government Office issued Notice 397/TB-VPCP, conveying the conclusions of Deputy Prime Minister Hồ Đức Phớc regarding the finalization of the Draft Replacement PIT Law.
Key topics under consideration include:

  • New tax calculation methods for bonus shares and dividend shares;
  • Tax calculation for real estate and securities to avoid market disruption;
  • More flexible personal deductions, considering inflation adjustment and actual income.
    The law is expected to be presented to the National Assembly in the October 2025 session, opening a comprehensive reform phase for personal taxation in Vietnam.

4. Other Taxes: Decree System Guiding the Amendment of Eight Finance, Investment, and Bidding Laws

Following the Law 90/2025/QH15, the Government issued a series of Decrees 167, 181, 182, 186, 214, 225/2025/NĐ-CP to detail regulations on customs, VAT, import-export taxes, public asset management, and bidding.
In particular, Decree 214/2025/NĐ-CP (04/08/2025) adjusts direct contracting thresholds with maximum limits:

  • VND 800 million for consulting services;
  • VND 2 billion for goods, construction, and non-consulting services.

Additionally, Decree 182/2025/NĐ-CP allows import duty exemption for goods serving science, technology, and innovation, promoting high-tech industry development.

5. Other Issues: Social Insurance, ODA Capital, and Enterprise Registration Procedures

  • Decision 2002/QĐ-TTg (11/09/2025): stipulates expenditure levels for social insurance (SI), health insurance (HI), and unemployment insurance (UI) in 2025 — including SI operations at 1.36% of total revenue and HI at 3.09% of contribution payments.
  • Decree 242/2025/NĐ-CP (10/09/2025): prioritizes the use of ODA and concessional loans for infrastructure, climate response, science & technology, and digital transformation projects.
  • Decree 168/2025/NĐ-CP: provides guidance on enterprise registration and change of head office address. The Tax Department requires enterprises to implement unified electronic tax codes across 34 provinces/cities, ensuring synchronized tax management.

  • Official Letter 4051/CT-NVT (25/09/2025): E-invoicing for public asset sales.
  • Official Letter 4025/CT-CS (24/09/2025): Land lease payments and related procedures.
  • Official Letter 25426/CHQ-NVTHQ (22/09/2025): VAT on returned export goods.
  • Official Letter 3958/CT-CS (19/09/2025): Land lease exemption documents and resolution process.
